Terms of Service

1. About the Platform

TurnSeasons ("the Platform," "we," "us") is an online directory that connects seasonal workers with housing providers and employers in tourism towns across the US. Landlords may post housing listings, employers may post job listings, and workers may browse both. We do not own, manage, or inspect any property listed on the Platform, and we are not an employment agency, recruiter, or staffing service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Platform. By using the Platform, you represent that you meet these requirements.

3. Platform Role: Housing

The Platform is an information directory only. We do not participate in, mediate, or become a party to any agreement, transaction, payment, or dispute between landlords and tenants. All rental arrangements — including pricing, lease terms, deposits, and conditions — are solely between the landlord and the tenant.

4. Platform Role: Jobs

We are not a party to any employment relationship. We do not verify employers, guarantee that any job is available or as described, or guarantee that any worker will receive an interview, offer, or employment. All hiring decisions, compensation, and terms of employment are solely between the worker and the employer.

5. No Guarantee of Accuracy

We do not verify, endorse, or guarantee the accuracy of any listing, including availability, pricing, photos, descriptions, compensation, or the identity of any landlord or employer. Users should independently verify all details before entering into any rental arrangement or employment relationship.

6. Accounts

You agree to provide accurate account information and keep your credentials secure. You are responsible for all activity under your account. We may suspend or terminate any account, or refuse service, at our sole discretion, including for violations of these Terms.

7. Your Content

You retain ownership of the content you submit to the Platform, including listings, photos, descriptions, and profile information. By submitting content, you grant TurnSeasons a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content for the purposes of operating, improving, and promoting the Platform. You represent that you have all rights necessary to submit your content and that it does not infringe the rights of any third party.

8. User Responsibilities

Users are responsible for the accuracy of information they provide. Landlords are responsible for ensuring their listings comply with all applicable local, state, and federal laws, including the Fair Housing Act. Users must not post fraudulent, misleading, or discriminatory content.

9. Fair Housing

All housing listed on the Platform must be offered in compliance with the Fair Housing Act and applicable state and local fair housing laws. Housing may not be offered, denied, or restricted based on race, color, religion, sex, national origin, familial status, or disability.

10. Prohibited Conduct

You may not: post false, misleading, fraudulent, or discriminatory content; impersonate any person or misrepresent your affiliation with any entity; use the Platform to send spam or solicitations unrelated to its purpose; scrape, harvest, or collect listings, data, or contact information by automated means; interfere with or disrupt the Platform or its security features; attempt to access accounts or data that are not your own; or use the Platform for any unlawful purpose.

11. Listing Removal

We reserve the right to remove any listing or other content at our sole discretion, including content that appears fraudulent, discriminatory, misleading, or in violation of these Terms.

12. Third-Party Links and User Interactions

The Platform may contain links to third-party websites. We are not responsible for their content or practices. Your interactions with other users — including any rental arrangement or employment relationship — are solely between you and those users.

13. Intellectual Property

The Platform, including its name, design, text, and graphics (excluding user content), is owned by TurnSeasons and protected by intellectual property laws. If you believe content on the Platform infringes your copyright, email hello@turnseasons.com with a description of the copyrighted work, the location of the material on the Platform, and your contact information, and we will review and respond appropriately.

14. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TURNSEASONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM RENTAL ARRANGEMENTS, EMPLOYMENT RELATIONSHIPS, OR OTHER DEALINGS BETWEEN USERS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

16. Indemnification

You agree to indemnify and hold harmless TurnSeasons and its owner from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Platform, your violation of these Terms, or your violation of any law or the rights of any third party — including any rental arrangement or employment relationship entered into through the Platform.

17. Governing Law

These Terms are governed by the laws of the State of Alaska, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Platform will be resolved in the state or federal courts located in Juneau, Alaska, and you consent to the jurisdiction of those courts.

18. General Terms

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a transfer of the Platform. These Terms are the entire agreement between you and TurnSeasons regarding the Platform.

19. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
